摘要
加强民办学校教职工合法权益保障,是推进民办学校教职工队伍建设、促进民办教育事业发展的重要举措。新修订的《民办教育促进法》的出台和实施,为加强民办学校教职工合法权益保障提供了新契机,亟待推进民办学校教职工合法权益的落地。文章在界定民办学校教职工合法权益相关内容及明晰民办学校教职工合法权益保障法理基础的前提下,对优化民办学校教职工合法权益的保障提出建议:夯实民办学校教职工权益保障的法理基础,完善民办学校教职工权益的协同保障机制,强化民办学校教职工权益保障的制度组织文化,增强民办学校教职工权益维护的意识和能力,以期更好地保障民办学校教职工的合法权益。
Strengthening the legal rights protection of staffs in non-governmental education institutions is an important way to promote the construction of staff team in non-governmental education institutions and promote the development of non-governmental education.The promulgation and implementation of the new Non-governmental Education Promotion Law provide a new opportunity for strengthening the protection of the legal rights and interests of staffs in non-governmental education institutions,and at present,it is urgent to promote the implementation of such protection.On the premise of defining the relevant contents of the legal rights and interests of staffs and clarifying the legal basis of their protection,this paper proposes suggestions for optimizing the protection of the legal rights and interests of staffs in non-governmental education institutions including:consolidating the legal basis;improving the collaborative guarantee mechanism;strengthening the institutional organization culture;and enhancing the awareness and ability to maintain the rights and interests.
