Retrospect and Prospect of the Development of Rule of Law in Non-governmental Education in the Forty Years of Reform and Opening-up

改革开放40年来,民办教育法治经历了恢复起步、快速发展、全面发展和深化发展四个阶段,民办教育法制体系进一步夯实,教育法治化进程加速推进。与此同时,民办教育法治面临教育法制供给不足、教育行政执法薄弱、依法治校实施乏力及法治教育实效较差等现实挑战。在新形势下,要深入推进民办教育分类管理、全力推动民办教育内涵式发展,关键在于:突出重点领域法制建设、优化民办教育法律体系;全面推行清单管理制度、推进民办教育依法行政;稳步推进教育法律实施、健全教育行政执法机制;深入推进依法治校建设、提高民办学校治理水平;加快推进法治教育工作、奠定民办教育法治基础;切实完善权利保障机制、维护利益相关主体权益。

In the 40 years since the reform and opening-up,the rule of law in non-governmental education has experienced four stages of recovery and starting,rapid development,comprehensive development and deepening development.The legal system of non-governmental education has been further consolidated and the process of rule-by-law in education has been accelerated.At the same time,it is also faced with the real challenges of insufficient supply of education legal system,weak administrative law enforcement of education,inadequate implementation of the rule of law in management,low effectiveness of legal education,and weak strength of rule by law.Under the new situation,it is necessary to further promote classified management and connotation development of non-governmental education.The keys are:highlighting the construction of legal system in key areas and perfecting the legal system of non-governmental education;comprehensively implementing the list management system and promoting the administration of non-governmental education in accordance with the law;steadily advancing the implementation of education law and optimizing the administrative law enforcement mechanism of education;further promoting the construction of institution governed by law and improving the governance level of non-governmental institutions;accelerating the education of the rule of law and laying the foundation for the rule of law in non-governmental education;effectively improving the rights guarantee mechanism and safeguarding the rights and interests of relevant subjects.
