依法治教是指依据法律来管理教育 ,也就是在以法律为依据的前提下 ,综合运用法律手段、经济手段、行政手段和其他必要的手段来管理教育。依法治教是时代的呼唤 ,是现代教育发展的必然要求。依法治教的实现必须具有完备的教育法律体系、健全的民主监督制度、公正严明的执法制度、廉洁秉公的执法队伍和提高全民的教育法律意识等 ,以保障教育发展的条件和制度。
