环境法主体范畴新探

Subject of Environmental Law

环境法的发展历史尚短,构筑环境法体系大厦的基石——环境法主体理论仍不稳定,学者对其范畴争论不休。本文在分析旧有理论的基础上对环境法主体的范畴进行了新探索,从环境法律关系出发界定了环境法主体,并对环境法主体资格的延伸进行了新的思考。

It is only dozens of years for development of the environmental law.The environmental law system building is constructed and its cornerstone,subject of envinronmental law is still being argued.In the foundation of old theories,new exploration is given.The legal relationship is the mother of subject.From the environmental legal relationship,subject of envinronmental law is defined.and its extension is thought about.
