通过检讨法学史上关于立法标准的几种观点,指出当代中国应当以马克思主义唯物史观和美学观为指导,确立立法评价的一般标准,同时结合当代中国宪法修改的实践,提出当代中国宪法修正案从法美学思维出发应当遵循的五大主要评价标准。

Through examining several kinds of standards about legislating in the history of law science,pointing out contemporary China should regard the materialist conception of history of Marxism and aesthetic view as guidance,establishing the general standard to legislation to appraise.Combining contemporary Chinese practice that constitution revise at the same time,putting forward contemporary China constitutional amendment proceed from aesthetic thinking of the law the five main evaluation criterion that should follow.
