论我国律师刑事辩护豁免权制度之构建

On the Construction of Lawyer’s Criminal Defense Immunity System in China

近年来,我国出现了一方面刑事案件不断增长,一方面律师刑事辩护率逐年下降的尴尬局面。究其原因,主要是由于我国缺乏对辩护律师人身权进行保障的律师刑事辩护豁免权制度所致。本文从我国构建律师刑事辩护豁免权的理论依据、价值所在和现实基础着手,探讨如何构建律师刑事辩护豁免权制度体系,从而维护律师的合法权益,进而维护犯罪嫌疑人、被告人的合法权益。

Our criminal law and criminal procedural law have some flaws on lawyer’s criminal defense system, which cause the awkward situation: criminal cases increasingly grew, while the rate of criminal defense dropped year by year. The main reason is that China has not the lawyer’s criminal defense immunity system that can provide safeguard to lawyer’s personal rights. This article begins with the theory basis, value and realistic foundation, trying to construct our lawyer’s criminal defense immunity framework to defend attorney’s legitimate rights, and further maintenance the suspect and defendant’s rights.
