Constitution is the Politics Community’s Spontaneous Order

历史上每个国家和历史时期都对宪法有不同的认识,但这些认识不免都处于一定的政治背景下。因此,当我们戴着政治意识这一有色眼镜去看宪法的时候,就会得出完全不同的结论。那么宪法到底是什么样子呢?要真正认识宪法,就必须剥去裹在宪法之上的政治外衣。从其根植于人类社会的秩序可以看出,它不是人类的创造物,它是自发生长的历史,经过人类理性的大浪淘沙而得以进化。

Every country in different history period has different cognition of constitution,but these cognitions are all on definite political background unavoidably.Therefore,when we wear this politics consciousness colored spectacles,we may reach the completely different conclusion.Then what appearance is constitution after all? If we want to know constitution in deed,we must strip the politics wrapping above constitution.From rooting the order in human society,we can know that it is not human being’s creature.It is the history growing spontaneously and it is the human society’s evolution though human rational filtration.
