摘要
著作权乃一种私权已成为一种共识,其权利外在表现形态与一般私权有着同一性,但本质却有着与一般私权的的不同属性,即著作权中人格因素的主导性。正是著作权的这一特殊的本质,决定了著作权客体的判断标准不是非物质性,财产性,而是人格性。著作权的支撑范围也应局限于这个判断标准之内。
Copyright is a private right,which has become a consensus.The external manifestations of copyright and other private rights have identity.But the nature of copyright has a different attribute that is the dominant factor in the personality of the copyright.It is the particular nature that determines the Criterion for the object of Copyright is personality rather than the features of non-material and property.Therefore,the judgment also limits the scope of the support copyright standard.
