类推适用及其正当性

Analogy and Its Justification

类推适用以类比推理为其逻辑基础。但作为类比推理的具体化形式,类推适用是有别于自然科学中的类比推理的,这种区别源于它所处理的问题的规范性,这种规范性涉及到实然与应然的关系。因此,类推适用的正当性问题,既包括"同类案件相似处理"这样一个外在正当性问题,也包括"是"与"应当"之间的过渡这样一个内在正当性问题。

Application of analogy is based on the analogy reasoning.As a form of analogy reasoning,application of analogy is different from analogy reasoning,and the differences derive from the normalization of the issues it deals with.The normalization involves the relationship of"the being"and"to be".So the justification of application of analogy involves not only the external justification that judge similar case,but also the internal justification that there should be a transition between"the being"and"to be".
