关于个人破产管理人制度的思考

Reflection on the Personal Bankruptcy Trustee System

个人破产管理人是我国《企业破产法》推行的一种管理破产案件的新模式。然而,个人破产管理人作为机构管理人的补充和辅助形式,法律和司法解释并未给于其足够关注。在个人破产管理人的任职资格及选任、民事责任承担以及报酬方面,法律规定的比较原则,部分内容缺乏可操作性,有必要进一步细化。

Personal bankruptcy trustee is a new Irustee selection model adopted by law of the Peoples Republic of China on Enterprise Bankruptcy.Since personal bankruptcy trustee is a complementary and assistant form to the institutional trus- tee,law and judicial interpretation did not pay enough attention to it.On the representation of personal bankruptcy trustee’ s qualification and selection,civil liability,and remuneration,China’s law only provides for the principle provisions.How- ever,part of the contents are lack of workability which needs further refinement.
