民事诉讼制度的功能,是指民事诉讼制度在解决纠纷中发挥的功效和能力,其内在所具有的对社会有益的功用和效能。民事诉讼的功能不同于民事诉讼的目的,"私权保障""维护法律秩序""纠纷解决"都属于民事诉讼制度的目的范畴,即设立民事诉讼制度所要达到的目标,是人们主观意志的体现。"程序保障"才是对民事诉讼功能的表述。"程序保障"功能应具备程序整体的可预期性、程序构建合理、程序的不可逆性等要素。
