城市化进程中失地农民的权益保障研究──以武汉城市圈建设为例

Study on Rights Protection of Landless Peasants in Urbanization──Taking the Construction of Wuhan City Circle for Example

土地征收是国家取得集体土地的唯一途径。在征地实践中,对"公共利益"界定不明确、滥用征地权、征地程序不透明、补偿程序有失公平、征地司法救济缺失等侵害农村集体经济组织和农民利益的现象屡禁不止。湖北省人大正在组织起草的《湖北省武汉城市圈"两型社会"促进条例》已将社会民生问题纳入立法规划。为了平衡征地中失衡的利益分配格局,从程序和实体两个层面保障武汉城市圈建设中失地农民的权益是两型社会建设和中部崛起战略的和谐要义。

Land acquisition is the only way to achieve collective land for our country nowdays.A large number of rural land will be used for infrastructure,industrial base and development construction in the integration of the Wuhan City Circle. In practice,there are many phenomena which violate interests of collective economic organizations and farmers, such as the fuzzy public interest,abusing of land rights, opaque land collection procedure,unfair compensation procedure,and missing of judicial remedy.The promotion of Wuhan City Circle and"the two-oriented society"is drafted by the People’s Congress of Hubei Province, which contains social and livelihood issues.To balance the imbalanced interests in land distribution,it is the harmony requirement that protects landless peasants’ interests from procedure and entity in the construction of Wuhan City Circle and the Central Strategy.
