论中国农民专业合作社的社员主体资格——以《农民专业合作社法》的相关规定为分析对象

Chinese Farmers’Subject Qualification of Co-operative Members——Based on the Relevant Provisions of the Farmer Cooperatives Law

社员主体资格是社员权成立和合作社各项制度构建的基础,我国《农民专业合作社法》遵从由抽象到具体的逻辑,分别从两个不同角度对主体资格做出刻画,从而将我国法上的社员主体类型化为三种情形。在各具体资格限制问题上,合作社法做出了一些努力,然而仍有待完善之处,不仅资格认定标准需要重新审视,若干不合理的限制也应取消或修正。

Members of the Subject Qualification is the basis for the establishment of the members right and the foundation of the systems,in accordance with the logic from the abstract to the concrete,China’s "Farmer Cooperatives Act" make a classification from two angles. Thus the main body of China’s Law on the type of members divided into three kinds. Cooperatives Act made some efforts on the specific qualifications; however,there are still areas to be improved. Not Only accreditation standards need to re-examine but a number of unreasonable restrictions should be abolished or revised.
