摘要
一般意义上讲,地理标志属于俱乐部产品,具有较强的公共性。地理标志的公共性决定了其外部性特征,因此,克服外部性是构建地理标志制度的必要前提。然而,作为制度产品的地理标志不具有可交易性,经济学意义上的外部性政策并不能用来解决地理标志的外部性问题。追本溯源,外部性本质上导源于决策单位的相互依赖以及决策权的分离,鉴于此,地理标志的外部性可以通过集中性控制政策与区分性使用政策予以治理。
Generally speaking,geographical indication is a kind of club good,and has strong public character.The public character of geographical indication determines its externality.Therefore,essential prerequisite of geographical indication system is to resolve its externality.However,geographical indication cannot be traded,because it is the product of the law system.Externality policy which is valid in economics cannot be applied to geographical indication.Both the separation of decision authority and correlative dependence of decision unit is the root of the externality.For that reason,centralized control and distinguishing use are all the resolutions to the externality of geographical indication.
