The Investigation Report on the Operational State of the Property Rights in the Rural Collective Economic——Taken Henan as an Example

农村集体经济是中国新农村建设的物质基础。作为集体经济的法律表现形式,集体财产权能否健康运行事关农村发展全局。但实地调查发现:无论是集体财产权的主体、客体还是具体的财产权形态,在实际运作中均存在诸多障碍,典型的如主体虚置、权能虚化以及功能虚弱。为此,应完善相关立法,强化国家在制度供给方面的支持力度。

The rural collective economic is the material basis of our new rural construction.As the law form of collective economic,the healthy operation of collective property rights are very important to the overall development of country.However,field survey shows that:there are many obstacles in actual operation whether it is the subject,object of the collective property rights or specific forms of property rights,such as the nominal subject,the weak power and function.Therefore,we should improve the relevant legislation and strengthen national support efforts in aspects of the system support.
