唐代和离制度研究综述

Literature Review on He-Li System in Tang Dynasty

唐代和离制度是指夫妻双方因为感情不和而自愿离婚的制度。目前,学术界主要采用三种视角对其进行研究。首先,整体分析其历史变迁并对其进行理论剖析;其次,以"放妻书"为中心分析它在社会历史中的实践运用;最后,揭示其历史意义并挖掘它的重要价值。在这种法社会史研究的基础上,立足于对现实问题的观察,通过法文化层面的剖析及古今协议离婚的比较,进一步挖掘唐代和离制度的现代价值,以此为现今协议离婚制度的完善提供传统法律文化动力。这或将成为一种新的研究趋势。

He-Li system in Tang dynasty refers to the system that the couple break the marriage at free will because of estranged affection.Now,studies of He-Li system in Tang dynasty are mainly from three different perspectives.Firstly,it analyzes its historical changes and further carrying on the theoretical analysis.Secondly,its practical application in the social history is being studied.Finally,it reaveals its historical significance and excavates its great values.Based on the study of legal society history and the observation of realistic problems,we should further excavate the important modern values of He-Li system in Tang dynasty,which could be used as the traditional legal culture power to improve the modern divorce by agreement system.All these may also become a new trend of study.
