摘要
工会监督权是指工会对国家行政机关和用人单位在执行国家劳动法律、法规和相关政策上具有监督的权利。新形势下,工会监督权暴露出制度与社会脱节等种种弊端,其原因在于工会国家化致其成为管理国家的工具。重建工会监督权,理应将其纳入社会本位视野下进行路径选择,以明确工会监督的维护职责,矫正工会监督权的价值功能、重构工会会员资格,倡导工会主席职业化、强化工会监督权的刚性力度,加大工会监督权的执法力度为完善思路,重塑工会的社会形象。
Supervision right of trade union refers to trade union’s monitoring rights on state administrative bodies and employers when they are in the implementation of national labor laws and regulations and related policies. Under the new situation,trade union supervision system exposes the drawbacks of disjointing between system and society,the reason for which is the nationalization of the union makes it more and more acting as a management tool for state. In order to rebuild supervision right of trade union,we should take it under the social standard perspective to do path selecting, so as to make clear the maintenance duty of union over sighting,to redress the value function of trade union supervision right and reconstruct the membership of union,to promote the professionalism of union chairman and strengthen the rigid dynamics of trade union supervision right,to intensify the law enforcement of trade union supervision right,in a word,to reshape the social image of trade union.
