摘要
费雪的《风险规制与行政宪政主义》分析了传统风险规制的科学路径与民主路径并阐释了两种路径所存在的弊端,她指出问题的症结乃是忽略了技术风险规制中公共行政的基础,贬低并忽视法律,为此她创造性地提出行政宪政主义的全新研究视角。当下风险规制决策模式也存在着科学与民主二分法的踪影,以费雪教授的行政宪政主义为视角,摒弃传统科学与民主二分法、解决技术风险规制合法性以及充分发挥专业性组织的作用是应对问题之策。
Fisher’s Risk Regulation and Administrative Constitutionalism analyzes the traditional risk regulation scientific path and democratic path and illustrates the two paths’ drawbacks,she pointes out the crux which ignores technical risk regulation in the foundation of public administration,belittle and disregard for the law,for which she creatively puts forward a new administrative constitutionalism research perspective. Today’s risk regulation decision model also exists trace dichotomy of science and democracy,based on Professor Fisher’s administrative perspective of constitutionalism,abandonning the traditional dichotomy of science and democracy,resolving technical risk regulation legitimacy and giving full play to the role of professional organizations,all these form the policy dealing with the problem.
