论染色体异常及其对我国量刑制度的影响

Theory of Chromosome Abnormality and Its Influence on Chinese Sentencing System

人类群体既具有生物性又有社会性,人的犯罪行为是生物性和社会性共同作用的结果。染色体异常这一生物性因素与犯罪具有密切联系,通过对其临床表现与犯罪之关系的分析,以及将染色体异常的罪犯与精神病人及又聋又哑的人在责任能力和生理上进行比较,得出将染色体异常这一生物性因素纳入量刑制度的必要性和可行性。在量刑情节的非行为事实中将其作为减轻、从轻刑事处罚的量刑情节之一。

Human group has both biological and social characters,and the human crime is caused by both of them. Chromosome abnormality,as a biological factor,is closely associated with crimes. Through the analysis of the relationship between the clinical manifestation and crime,and the comparison between the criminals of chromosome abnormality,the mental patient and deaf and dumb person in capacity for responsibility and physiology,it concludes that including chro-mosome abnormality in sentencing system is necessary and feasible. The non- behavior facts of sentencing shall act as one of the facts to reduce or lighter criminal penalties.
