节能减排视角下行政处罚目的之转型及其实现方式

Transformation of the Administrative Penalty’s Purposes and Approaches in the View of Energy-Saving and Emission-Reduction

行政处罚的设定是为了预防行政相对人的违法行为,在违法行为发生以后制止相对人的违法行为,同时起到教育引导与规范的作用,低碳社会建设中除了保持该目的之外,需要进行拓展,向补偿性、恢复性以及教育性的目的方面转型,并以此为基础创新处罚形式,以促进节能减排的实现。

The setting of administrative penalty is to prevent the illegal actions of the administrative counterpart,restrain the administrative counterpart after the happening of the illegal actions,and to educate the administrative counterpart’s actions. In the development of the low carbon society,except to maintain the preventive purpose and the deterring purpose,it is important to transform these purposes to compensatory purpose,recovery purpose and educational purpose. At the same time,it is an urging to innovate the forms of administrative penalty based on these kinds of purposes and to achieve the society of energy- saving and emission- reduction.
