法制统一视角下行政诉讼法律适用问题探讨

Study on the Application of Administrative procedure Law in View of Uniformity of Law

法制统一原则是推进社会主义法治必须坚持的基本原则,也是推动法治国家、法治政府和法治社会一体建设的基本要求。在法制统一原则的指引下,以现实行政诉讼的实例来探究行政诉讼法律适用的困境,进而对有关行政诉讼法律适用中的规定进行解读来察其症结,最后针对行政诉讼法律适用中的问题提出相应的修改和完善建议。

The uniformity of legal system is a basic principle to build a society ruled by Law and it’s also the basic request of law integration. Guided by this prinaple,dilemma can be studied by using the practice of Admnistrative Procedure Law and then the sticking point can be further analysed and at last proposals to improve the current situation can be put forward.
