社会变迁语境下方法的重构及理论的自觉——读昂格尔的《现代社会中的法律》

The Reconstruction of Method and Consciousness of Theory in the Context of Social Change——An interpretation to Law in Modern Society by Unger

社会的变迁导致了经典社会理论的困境,昂格尔对社会理论的方法进行了重构,并且,通过对现代社会中法律位置的思考来间接地探讨方法论、社会秩序以及现代性等理论问题。通过把西方一些法学家所提出的法律演进的模式与昂格尔所提出的后资本主义社会法律发展方向进行比较,不仅会进一步看到后资本主义社会法律将会走向何方,而且也会进一步体察到西方法学家的理论自觉,从而对我国的法治建设和法学理论的发展有所启示。

Due to the plight of classical social theory which is caused by social changes,Unger reconstructed the method of social theory. Moreover,through thinking of the legal position in modern society,Unger explored indirectly theoretical issues such as methodology social order and modernity. By comparing some Western legal evolution model proposed by jurists with the direction of development of post- capitalist social laws proposed by Unger,not only will we further see where the law in western post- capitalist society is going,but also further experience and observe the theoretical consciousness of western jurists,and thus it will be beneficial for the development of the rule of law and legal theory in our country.
