The philosophy of law always has certain political implications. It has been proved by the development of the philosophy of law in China and in the west that the development of the philosophy of law in specific historical period is closely related with the development of politics. Thus it’s full of significance to deconstruct the political factors which exist in the development of the philosophy of law. However,great differences exist in the development of philosophy of law in China and in the west,because the politics plays a leading role in the development of the philosophy of law in China,while it is not in the west. Therefore,the Chinese scholars should always uphold the spirit of reflection and criticism,so that the development and research of the philosophy of law will have a proper distance with politics. Thus,both the philosophy of law and politics will develop steadily and healthily.
