村民自治权权利属性的证成及实现

Justification of the Villages’ Autonomy Rights Attribute and Its Practical Path

村民自治权作为村民自治的核心和推动村民自治实践不断发展的基础命题,在村民自治研究中占有重要的地位。基于此,从村民自治权是权利,还是权力,抑或兼具权利和权力的属性之争出发;经由对村民自治权的归属和权利本质属性的认知以及社会自治权的提升三个层面来对村民自治权的权利属性进行证成;最后落脚到以村民自治权的权利属性为基点,从《村民自治法》的角度来保障村民自治权的实现。

As the core of the villages’ autonomy and basic proposition,the villages’ autonomy and to promote the development of villages’ autonomy practice is very important in the study of villages’ autonomy. Based on this,with the starting quesfton of whether the villages’ autonomy is right or power or both and through the ownership of the villages’ autonomy and acknowledge rights essential attribute as well as improve the social autonomy,this paper certificates the right of the villages’ autonomy attribute; Finally,from the perspective of the law of villages’ autonomy,this paper finds out the way to ensure the implementation of the villages’ autonomy.
