犹豫期条款引入《保险法》之法理分析

在保险业较为发达的德国和台湾地区,犹豫期条款以成文法的形式对人身保险合同的消费者予以特殊的保护,而我国《保险法》对犹豫期条款的规定极为有限,仅散见于部门规章及规范性文件中。犹豫期条款作为人身保险合同特有条款,其存在的法理基础在于:以契约自由为起点,由契约严守做出适度让步,从而维持保险契约当事人之间实质的对价平衡关系。犹豫期内的权利为具有强制约定性质的法定解除权,可衔接与我国《合同法》,为其引入《保险法》提供可行性路径。犹豫期条款与投保人任意解除权、保险契约审阅期的诸多不同凸显了犹豫期条款引入之独特价值。

Hesitate provisions has been written rules of the insurance law in Germany and Taiwan,where the insurance has been more developed in the world,to protect the consumers of personal insurance contracts in a special way,however,the hesitation provisions is in backward state in China’s Insurance Law and regulation system,because it was only scattered in the departmental rules and normative documents and the limited protection for the insurance consumers.As a unique person insurance contract terms,the existing legal basis of the hesitation provisions is that the contract strictly makes modest concessions with the freedom of contract,as a starting point,in order to maintain the substantial balance of the price relationship in the insurance contract,providing a possible path for the introduction of China’s Insurance Law.The unique value of the period of hesitation period is the differences between the period of hesitation and period of review.
