重混音乐作品中他人旋律片段可版权性研究

摘要 重混音乐作品在我国已呈现勃兴之势,但这类包含他人音乐作品中部分旋律片段的作品类型却可能侵犯了他人著作权。版权维权过程中权利的存在才能有相应的救济,确认诉争旋律片段版权的存在是侵权指控成立的首要前提。然而,重混人对他人旋律片段在长短、音色、节奏上的诸多改变阻碍了旋律片段可版权性的认定,导致权利人对这些旋律片段的维权困境。实际上,只有满足版权客体特征的旋律片段才可获得著作权法保护。重混音乐作品中他人旋律片段是人智力创作的成果,表达具备了客观的感知性,但旋律片段'最低限度独创性的标准'还需借助'主观新颖性概念'与'统计学上首次'来判断。 While remix music works have became increasingly prosperous in our country,it may infringe the copyright of others’,because this kind of music contains part of the melody fragments that is from earlier known music works.In the process of copyright protection,the existence of the copyright to the melody fragment is a significant prerequisite for the verification of the alleged infringement. However,the changes in length,timbre and rhythm of these melody fragments hinder the identification of the ability to obtain copyright of the melody fragments,subsequently puts the rights holders into a predicament. According to the common requirements of works in copyright law,melody fragments in remix music must be others’ intellectual and creative achievements,and possess objective and perceptual expression,the test of the "minimum original standard "of melody fragments must satisfy "subjective original conception "and "statistical first"standard.
