2016-2017年江西省医疗机构依法执业行政处罚情况分析及对策

Aadministrative penalties imposed by medical institutions operating in accordance with the law in Jiangxi province during 2016-2017: An analysis and countermeasures

目的了解2016-2017年江西省医疗机构依法执业监督执法和行政处罚情况,为做好江西省医疗机构依法执业监督执法工作提供参考。方法从国家卫生监督信息系统中导出2016-2017年江西省医疗机构行政处罚数据及依法执业专项检查数据,对有关数据进行描述性分析和比较分析。结果2017年与2016年相比,医疗机构行政处罚案件数和监督行政处罚率有所上升,监督覆盖率、户均监督频次和平均每案件处罚额度无差异。诊所和村卫生室(所)是当前该省医疗机构依法执业行政处罚案件的主要处罚对象,违反抗菌药物临床应用管理规定、诊疗活动超出登记范围和使用非卫生技术人员从事医疗卫生技术工作是当前医疗机构主要违法行为。结论江西省医疗机构依法执业监督行政处罚率逐年上升,依法执业违法行为监督处罚力度加大,各级卫生计生综合监督执法机构要高度重视社会举报投诉,认真受理群众举报投诉,提高监督行政处罚率,加强个体诊所和村卫生室(所)等重点场所监管,加大精神卫生监督和医疗美容监督执法,保障人民群众健康权益。

Objective To learn about the supervision,law enforcement and administrative penalties imposed by medical institutions in accordance with the law in Jiangxi province from 2016 to 2017,and to provide reference for the supervision,law enforcement work of medical institutions in Jiangxi province.Methods The 2016-2017 administrative penalty data and specific inspection and supervision data of medical institutions in Jiangxi province were collected from the national health supervision information system,and descriptive analysis and comparative analysis were conducted on the relevant data.Results Compared with 2016,the number of cases of administrative penalty and the rate of supervision on administrative penalty by medical institutions increased in 2017,and there were no differences in supervision coverage,average supervision frequency and average penalty amount per case.At present,clinics and village health offices(clinics)were the main objects of administrative penalties.The main illegal behaviors included violating the regulations on the management of clinical application of antimicrobial agents,exceeding the scope of registration for diagnosis and treatment activities,and hiring non-health technical personnel to engage in medical and health technical work.Conclusions The rates of law enforcement and administrative penalty imposed by medical institutions in Jiangxi province in accordance with the law rise year by year.The supervision and punishment has been strengthened.Health supervision and law enforcement agencies at all levels should attach great importance to social reporting complaints,take seriously the complaints of the public,improve the rate of supervision and administrative penalty,strengthen supervision on key sites such as private clinics and village clinics,strengthen mental health and medical cosmetic supervision,and safeguard the rights and interests of people’s health.
