摘要
《中华人民共和国物权法》颁行后,对我国社会生活的各个领域均产生了重要影响。在婚姻家庭中的财产关系中,物权法与婚姻法存在交叉调整的现象。这种现象的存在在实务中将引起法律操作的不便,进而影响法律的权威性。因此,消除二者之间的冲突与调整空白是当前我国学者应当着力研究的目标。
After the People's Republic of China Laws on Property Rights has issues and came into effect,it has exerted important influences on our social life in each domain.With regard to property relations in the marital field,Laws on Property Rights and Marriage Law have something overlapped and adjustments.This kind of phenomenon will cause legal operation invariable in the practice,further influencing the law's authority.Therefore,eliminating the conflict and adjusting the gap are what current scholars should try to study.
