Women's legal status in the Ming Dynasty

介绍明朝法律关于在室女、为人妻者法律权限的规定以及女性犯罪、女犯宽宥情况 ,通过与唐、宋、元代相关法律的比较 ,探讨明代妇女的法律地位 ;通过考察明朝法律实践和社会实际 ,揭示明代妇女法律地位“低中有高”的特点 。

The paper first introduced some juristic items which stipulated the legal rights for the unmarried and married women and also introduced the situations about female crime-committing and forgiveness to female criminals. Comparing these items with those in the Tang Dynasty, Song Dynasty and Yuan Dynasty, it explored women’s legal status in the Ming Dynasty. Furthermore, through the investigation into the juristic practice and social facts in the Ming Dynasty, the paper reveals that women’s legal status was primarily low but higher in some aspects compared with their counterparts in the past. The causes for the above phenomenon are analyzed briefly.
