摘要
清末修律中法理派满汉民族平等思想的形成离不开晚清社会发展要求各民族一律平等的现实需要、中西平等理念或思想提供的理论来源以及清末修律提供的实践基础等社会历史条件。在清末修律中,法理派主要提出了满汉民族适用法律平等、司法平等和经济地位平等三个方面的满汉民族平等思想,并使之进入了法律体系,在相关修律成果中得到了一定程度的确认。法理派满汉民族平等思想具有时代进步性和历史局限性的双重性质。
In the late Qing Dynasty’s law revision,the formation of Jurisprudence School’s equality thoughts between Manchu and Han nationality were inseparable from the social and historical conditions,such as the realistic needs for equality of all nationalities,the theoretical sources provided by the Chinese and Western equality ideas and the practical basis provided by the late Qing Dynasty’s law revision. In the late Qing Dynasty’s law revision,the Jurisprudence School mainly put forward three equality thoughts between Manchu and Han nationality,including equality of applicable law,judicial equality and equality of economic status,and brought it into the legal system,which has been affirmed to a certain extent by the relevant achievements of law revision. The Jurisprudence School’s equality thoughts between Manchu and Han nationality have dual nature,that is,the progress of the times and the limitation of history.
