我国宪法宣誓的责任机制研究

A Study on the Responsibility Mechanism of China's Constitutional Oath

法律制度的生命力在于实施,现有宪法宣誓在责任规制上的缺失很容易导致宪法宣誓制度流于形式。为了强化宪法情感、树立宪法信仰,我国必须建立宪法宣誓的相关责任机制,在完善监督机制的基础上,以取消资格、罢免等责任形式落实宪法宣誓,以促进宪法宣誓制度的完善。

The vitality of the legal system lies in its implementation.However,the absence of responsibility mechanism in the present constitutional oath system easily makes the constitutional oath become a mere formality.In order to enhance the emotions over Constitution and set up faith in Constitution,China must establish relevant responsibility mechanism of constitutional oath system and on the basis of perfecting supervision mechanism,the nation should implement the constitutional oath in forms of disqualification and dismission so as to promote the perfection of the constitutional oath system.
