摘要
批评教育学生原本是教师的责任和法律赋予教师的权利,对违纪学生进行必要的惩戒处罚也是重要的教育手段。但由于现行法律法规中教育惩戒处罚相关规定的缺失,批评教育、教育惩戒容易被混淆于体罚、变相体罚,在这样的情况下,教师在行使教育权、处理因学生不当行为而导致的突发事件时,教育惩戒处罚的尺度不易把握,不仅无法保障学生的权利,也使教师常常无法正常行使自己的教育权,甚至有被控违法的风险。基于教师自我监控能力理论,结合教师班级管理实践,本研究提出惩戒教育"五段"管理模式,将有助于教师有效区分、合理界定体罚与惩戒,从而使惩戒与育人并重,为教师正确行使教育权提供借鉴。
Under the current system of laws and regulations, criticism and certain warning punishment which used to be a necessary educational means are usually likely to be equated with corporal punishment in certain shape. As a result, teachers find it difficult tobalance between exercising the educational right and violating the educational laws and regulations. Based on the theory of teacher’sself-monitoring, the paper puts forward tentatively the 'Five-Grading' Managing Mode which is likely to help teachers to solve the dilemma.
