论刑法学教育的基本维度及应处理好的几个关系

On the Essential Elements of Criminal Law Education and Several Relations that should be Handled

在改革开放日益深入、社会矛盾凸显复杂化的新时期,自由与秩序、惩戒与宽容、功利与价值等两极观念的碰撞逐渐加剧,如果刑法学教学与研究还局限于法条的阐释,则无异于冥行盲索。刑法学教育工作者的任务不仅是传授刑法学知识,还负载着培养"法之理性"的使命,肩负传递法律的价值、意义的重大责任。刑法学教学应处理好刑法学知识与刑法学实践的关系、体系性思维与个案正义的关系、域外学说与本土法制的关系以及刑法与其他学科的关系。

With the aggravating conflict between freedom and order, punishment and leniency, utility and values under the new situation, the teaching and research of science of criminal law should be unescapably given new missions such as handling therelationship between criminal jurisprudence and practice, systematic considerations and justice in individual cases, extraterritorial theories and domestic laws, science of criminal law and other disciplines.
