摘要
丁韪良(William M. P. Matin)所译的《万国公法》是中国法治近代化过程中的最有影响力的翻译作品之一。然而,任何伟大事物的产生都不是偶然的,它的产生既离不开其背后的社会历史因素的作用和影响,也离不开译者的主观努力。本文引入布迪厄(Bourdieu)场域理论中场域、资本、惯习三个核心概念对《万国公法》作宏观、中观、微观探讨,剖析社会历史背景、译者成长经历、职业习惯、思想偏好等对《万国公法》翻译活动的影响。
Elements of International Law,translated by William M.P.Matin,is one of the most influential works of translation in the modernization of the rule of law in China.However,just as the emergence of any great things is not accidental,its emergence is not only inseparable from the social and historical factors behind,but also from the subjective efforts of the translator.In this paper,three core concepts of Bourdieus Field Theory—field,capital and habitus—are introduced to make a macro,medium and micro discussion of Elements of International Law and to analyze the influence of social and historical background,the translatorsgrowth experience,occupational habits and ideological preferences on the translation activities of Elements of International Law.
