互联网背景下我国食用菌产业发展及法律规范问题研究

Research on the Development and Legal Norms of Edible Fungi Industry in China under the Background of Internet

食用菌产业具有良好的发展前景,但是现今该产业缺乏较全面、系统的法律法规。通过创建食用菌示范基地,成立产业实体,运用电子商务将食用菌带向全世界,令该产业逐渐发展壮大。食用菌产业虽然具有较好的发展前景,网络可以提升食用菌产业的发展水平,但是在生产和管理的过程中会出现一些问题,主要有三方面:一是菌种品种被侵害,维权难;二是菌种生产和销售混乱,质量事故频发,处理解决难;三是越级生产菌种,存在管理难的现象。要解决上述问题,需要建立健全的、系统的法律法规体系;另外,还需要国家制订菌种保险办法,化解风险;最后相关部门加大农业法律的宣传力度,为食用菌产业的发展提供帮助。

The edible mushroom industry has good prospects for development,but nowadays it lacks comprehensive and systematic laws and regulations.Through the establishment of demonstration bases for edible fungi,the establishment of industrial entities,the use of e-commerce will bring edible fungi to the world,so that the industry gradually grows.Although the edible mushroom industry has good development prospects,the network can improve the level of development of the edible mushroom industry,but there are some problems in the process of production and management.There are three main aspects:one is that the species of mushroom are infringed,and it is difficult to safeguard their rights,the other is that the production and marketing of mushroom are confused,quality accidents occur frequently,and it is difficult to deal with and solve them;the third is that the production of strains difficult phenomena.To solve these problems,we need to establish a sound and systematic system of laws and regulations,in addition,we need the state to formulate fungus insurance measures to mitigate risks,finally,relevant departments should increase the publicity of agricultural laws to help the development of edible fungus industry.
