摘要
行政优先权在我国行政法治层面上包括了行政法关系的单方面性、行政职权的推定正确性和行政主体行政权威等内容;理论层面上则决定了我国行政法理论体系的发展脉络,并成为与西方控权性行政法的分水岭;方法论层面上则使平衡论、管理论、服务论有了似乎合理的解释进路。然而,加入WTO以后,行政法的国际化倾向则不能容忍行政权优先于法律。为了理清法律优先的经纬,本文以对比的方式从宪政思想、法治理念、调控方式等方面对行政优先权与法律优先予以分析,并使我们必然对法律优先作出选择。
On the level of the rule of administrative law, the power of administration priority include contents of one- sidedness of the administrative law relation, concluded validity of the administrative powers, administrative authority of administration subjects, etc; on the level of theory it decides the development train of theoretical system of administrative law in our country and becomes the watershed between the administrative law characterized by the control of administrative power in western country and the administrative law in our country ; on the level of methodology it makes the equilibrium theory , the administration theory and the service theory have seemly reasonable access to interpretation . However, internationalization tendency can’ t permit that the administrative power is prior to the law after China’ s entry to WTO. In order to make clear the longitude and latitude of the law priority, this article analyzes the power of administration priority and the law priority by comparison from the aspects of the thinking of constitutional governance, the theoretical ideology of the rule of law, regulative methods, etc, and makes it inevitable that we choose the law priority.
