Network Intellectual Property Protection Dilemma and Solution Path

我国知识产权保护的困境,可归纳为网络知识产权侵权的立法空白和司法欠缺。在立法方面,网络知识产权发展迅速,立法跟进尚未能及;网络侵权主体多样,责任机制规范不明。在司法方面,网络侵权管辖存疑,侵权发生地认定困难;举证责任分配不明,维权欠缺双重支持。纾解网络知识产权保护困境,首先,立法需跟进时代,重划权利及证据范围;准确界定侵权主体,完善侵权责任立法规则;其次,司法层面需完善网络侵权管辖原则,加大法律援助力度;完善举证责任机制,引入损害认定技术。

The dilemma of intellectual property protection in China can be summed up as the blank of legislation and the lack of judicature.In the aspect of legislation,the network intellectual property develops rapidly,but the legislation has not been able to follow up.What is more,the subjects of network infringement are various and the responsibility mechanism is unclear.In the aspect of judicature,the jurisdiction of network infringement is doubtful,and it is difficult to identify the place where the infringement occurs.The distribution of proof burden is unclear,and the protection methods of rights lacks double support.To ease the dilemma of Internet intellectual property protection also need measures of two aspect.Firstly in the legislation level,law makers should follow the times and redraw the scope of rights and evidence,define the subject of tort accurately and perfect the legislation rules of tort liability.Secondly,in the judicial level judiciary authorities need to improve the network infringement jurisdiction principle,increase the legal aid strength,improve the distribution of proof burden mechanism,and introduce the technology of damage identification.
