伪造盗用IPPC标识执法问题及建议探讨

目前,伪造盗用IPPC标识行为的情况比较严重,而且执法中遇到的问题也比较突出。本文从调查难、取证难、立案难、处罚难4个方面分析了执法中遇到的问题,同时又从公检联动、林检联动、民事诉讼、申请商标、完善法律法规、诚信管理、加强宣传7个方面提出了措施或建议。

At present,forging and embezzling IPPC mark were acccumulated seriously,moreover, problems in law enforcement were become increasingly urgent. From the investigation difficulty,obtaining evidence difficulty, filing difficulty, punishment difficulty, we analyze the problems existing in law enforcement.At the same time,The authors proposed measures or recommendations from the cooperation of Public Security Bureau and Entry-Exit Inspection and Quarantine Bureau,the cooperation of Forestry Bureau and Entry-Exit Inspection and Quarantine Bureau, civil litigation, application for the trademark, perfecting laws and regulations amendment, credit management, strengthening propaganda.
