摘要
在化学及生物医药领域的专利布局中,杂质化合物是近年来较为突出的一个热点问题,其可专利性也具有颇多争议。本文笔者对不同情况下研发得到的杂质化合物的可专利性的核心要求,即实用性、专利保护的客体、新颖性和创造性方面的问题进行了全面的判断和分析,希望给相关领域从事研发、生产、质量、知识产权方面的人士提供一些有益参考。
In the patent layout in the field of chemistry and biopharmaceutical industry,impurity compounds have become a hot topic in recent years,and their patentability has also been quite controversial. In this paper,the authors made comprehensive judgments and analysis of the key requirements of the patentability of impurity compounds developed under different circumstances,including requirements of utility,subject matter of patent,novelty and inventiveness. We hope to provide some useful references for people in the fields of R&D,production,quality control and intellectual property.
