浅议老年人居住权的法律保护

On Legal Protection of the Living Right of Elderly People

老年人是受法律保护的特殊群体,司法实践中多发老年人居住权纠纷,物权法的空白迫使其寻求其他部门法的保护,然法律之间存在冲突,这对此类案件审理造成混乱。因此在我国立法尚未确立居住权背景下,笔者试图从物权法和其他法律的角度浅议老年人居住权的法律保护。

Elderly are a special group on the law,the residency dispute frequently occurs in judicial practice,a blank on the Property Law forcing it to seek protection from other branches of law,however there are conflicts between the law which lead confusion to hear such cases. Therefore,under the Chinese Legislation has not been established housing rights background,the author attempts to discuss legal protection of the elderly from the perspective of Property Law and other laws.
