On the Channels to Realize Legal Globalization

文章考察了当前比较有典型意义的几种法律全球化理论,区分出实现法律全球化的几种途径,特别是以现代商人习惯法为基础实现法律全球化的途径,借以回答法律全球化是否可能,将以何种方式以及在多大程度上实现的问题。

On the basis of observing and studying several typical present theories of legal globalization and distinguishing several ways, especially the way to realize the legal globalization on the ground of the modern business customary law, this paper gives the answers to the following questions: the possibility of the legal globalization, how and to what extent to realize it.
