转质制度研究

A Study of the Repledge System

转质具有两种类型 ,两种类型之间有较大差异。对责任转质的定性 ,通说采质物再度出质说。追究权源 ,该主张有不可避免的缺陷 ,应采债权与质权共同出质说。以定性为基础 ,转质关系中各方当事人的权利义务应本着利益平衡的精神予以合理安排。在物权体系的构造中 ,转质制度具有根本困惑 ,但衡于利弊 ,我国物权法仍应同时规范转质的两种类型。

There exist two types of repledge, Repledge with Responsibility and Repledge with Agreement, with considerable differences between them. The paper discusses in detail the definitions, nature and shortcomings of the two types of repledge. With the consideration that the profits of the various parties involved should be balanced, the paper holds that specific standards should be set for the two types of pledge in China.
