Analysis of the Hegel′s Conception of Right

黑格尔的权利观念建立在"自在自为地存在的合乎理性的意志"实体性基础上;权利的实现必须具备意愿之表达,对物之占有及他人的承认三个要件;权利和义务的关系密不可分。黑格尔的权利学说极其深刻,改写了西方自然法哲学中的权利观念,标志着以权利与权力关系为基本问题的近代法哲学体系的形成。

Hegel′s conception of right is established on the concrete basis of 'the will which conforms to reason and exists freely'. And it must be provided with three essential factors to realize his right, that are, the expression of wishes, the occupation of substance, and others′ admission. As we know, right and obligation are closely linked. Hegel′s theory of right is so profounel that it even rewrites the conception of right in the field of natural law philosophy in west, and symbolize the formation of modern law philosophy system, whose question is the relation between right and power.
