受教育权平等有着丰富的内涵,其中入学机会的平等是受教育权平等的基本内容。初等教育和中等教育要求"平等对待"的平等。而在目前条件下,受高等教育的平等是"标准的平等"和"标准面前的平等"。我国目前在保障公民的受教育权平等方面存在着一些严重的问题。保障公民的受教育权平等迫切需要立法权和行政权的积极作为,并且必须为受教育权平等提供司法保障。

The equality of the right to education has substantial connote, and its central content means equal access to school. The right to primary education and the right to secondary education ask for the equality of' fair treatment ', and under the present conditions , the equality of the right to higher education is ' equal standard ' and' equality facing standard '. There are many serious problems about the protection of citizen sequality of the right to education in our country. It demands the positive act of legislative power and executive power to protect the equality of the right to education , meanwhile judicial safeguard must be offered to it .
