摘要
英国《大宪章》蕴含着现代意义上的控权与人权的法治精神。经过近800的生长,这种精神凝结成经验,演化为制度,最终权力得到有效控制,人权得到扩展和实现,形成了英国特有的法治传统。《大宪章》之法治精神的生长有以下特点:强烈的经验性;总体进程中呈自然演进,具体问题上不失理性建构;斗争过程中呈激烈对抗,结果往往妥协退让;起点是相对性契约,逐渐演化为普遍性法律。这些对我国法治建设有重要的启示意义。
To some extent, Magna Carta embraces modern spirit of law which means state powers being controlled and human rights being safeguarded. For about one thousand years' growth, the spirit of law has been turned into experience and system, so that state powers have been effectively controlled and human rights enlarged and realized. The growth of spirit of law has some key characteristics: strong experience; natural evolution as a whole; some reasoning construction in several problems; intense conflict in the struggle with compromising result; beginnig with relative contract and ending with universal law. All these have inspiring significance to our construction of law.
