Validity of Law

法律效力是法律从规范的静态存在走向实践的动态存在的内在根据。法律效力是指内含于法律中的对法律调整对象产生作用的能力。因之,其可分为内部效力和外部效力。法律效力的实体根据在于法律的合需要性与合规律性(统称合目的性),其形式根据则在于对语法、逻辑、修辞等语言工具的尊重和对内部之正当程序和外部之必要强制的坚守。

Validity of law is the inner basis of law transferring from static existence as rules to dynamic existence as praxis. It refers to the capacity of law to exert influence on the adjusting objects. Thus, it can be categorized into inner and outer validity. The substance basis lies in requirement and rationality, while its formal basis lies in the respect to language tools such as grammar, logic and rhetoric and the obedience to inner right program and outer necessary compulsion.
