我国无效婚姻之诉刍议

Simply On the Suit of Void Marriage in China

我国新婚姻法对婚姻之无效是否必须经法院判决毫未提及,同时实体规范和程序规范都对无效婚姻之诉缺乏具体规定,但从最高人民法院司法解释第七条的规定来看,我国无效婚姻之诉是现实存在的。笔者仅就我国无效婚姻之诉所涉及的有关问题进行探讨。

Our state's new marriage law is not concerned with the declaration of void marriage by courts, but there exists the suit of void marriage in light of Article Ⅶ, the Supreme Court's interpretation. For there are no concrete stipulations on void marriage in the substantial and procedural rules, I just probe into several issues concerned with the suit of void marriage.
