摘要
通过对国外律师风险代理制度的立法比较,论述了我国建立这一制度的实践价值和障碍,进而提出构建我国律师风险代理制度需要通过对其适用范围、基本开支的支付、律师请求留置权的赋予和律师收费评定制度等方面进行立法来加以规范。
There are diverse stipulations concerning lawyers' risk deputizing system in different countries. It is of positive value to establish such a system in China, but it is by no way easy. The establishment of such a system requires legislation that defines the areas the law applies to, the way to pay basic costs, lawyers' request of lien, and charge evaluation.
