虚拟企业是为了适应新的经济形势产生的新的企业组织形式。法律问题贯穿于虚拟企业整个生命周期。从虚拟企业的法律环境上讲,《合同法》和知识产权法对虚拟企业的组建与运行十分重要。虚拟企业经常采用的四种合作类型涉及不同的合同内容,中国适用于电子合同、网络交易的法律不健全,这对虚拟企业的运行影响较大,应建立电子通信安全认证机制等措施,促进虚拟企业的发展。

A virtual enterprise is one of the new enterprise organization forms that appear to meet the need of the new economic situation. The emergence of virtual enterprise brings forth new law issues, which has drawn more attention of related people. This article discusses the virtual enterprise law issues from the following aspects: law environment, law attributes, law issues that might appear during the process of establishing virtual enterprises and agreement.
