论传统中华帝国的“同罪异罚”思想

On the Idea of “Identical Crime and Different Punishment” in Fedual Period of China

通过对贯穿于我国封建时代的“同罪异罚”思想进行历史回顾 ,并对“八议”思想的分析 ,可以看出“同罪异罚”在封建帝国存在的合理性 ,它是传统国家君主、官僚、乡土社会张力作用的要求 ,但“同罪异罚”的灭亡是其历史宿命。

This article reviews 'the identical crime and different punishment',which runs through the feudal period,and began with the thinking of 'eight talk',the author analyses the reasonable existence of this idea in empire.Its the requirement of the expend power between the king,bureaucrat and the local society in traditional nation,but 'the identical crime and different punishment' is doomed to perish.
